Participation Waiver

1. Introduction

This Participation Waiver ("Waiver") applies to all events, activities, programmes, and services organised or facilitated by Elevate Together ("we", "us", or "our"). By participating in any of our activities, you acknowledge that you have read, understood, and agree to be bound by the terms of this Waiver.

2. Acknowledgement of Risk

I understand that participation in Elevate Together events and activities may involve certain risks, including but not limited to:

• Physical activities that may result in injury
• Exposure to outdoor elements and environmental conditions
• Interaction with equipment, tools, and materials
• Transportation to and from activity locations
• Contact with other participants and members of the public
• Gardening and horticultural activities involving soil, plants, and tools

I voluntarily assume all risks associated with my participation, whether known or unknown, and accept personal responsibility for any injury, loss, or damage that may occur.

3. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge Elevate Together, its directors, officers, employees, volunteers, agents, and representatives from any and all liability, claims, demands, or causes of action that may arise from my participation in any activities, including but not limited to:

• Personal injury or illness
• Property damage or loss
• Death
• Any other harm or loss of any kind

This release applies regardless of whether such liability arises from negligence, accident, or any other cause, except for cases of gross negligence or wilful misconduct.

4. Health and Fitness Declaration

By participating in Elevate Together activities, I confirm that:

• I am in good physical health and capable of participating in the activities
• I do not have any medical conditions that would prevent safe participation
• I will inform organisers of any allergies, medical conditions, or special requirements
• I will follow all safety instructions and guidelines provided by staff and volunteers
• I will use equipment and materials responsibly and as directed

5. Photography and Media Consent

I understand and agree that photographs, videos, and other recordings may be taken during Elevate Together events and activities. I grant Elevate Together permission to use such images for:

• Promotional materials and marketing
• Social media and website content
• Newsletters and publications
• Funding applications and reports
• Press and media coverage

If you do not wish to be photographed, please inform our staff at the beginning of each event.

6. Code of Conduct

All participants are expected to:

• Treat all participants, staff, and volunteers with respect and courtesy
• Behave in a safe and responsible manner at all times
• Follow all instructions from event organisers and staff
• Refrain from any behaviour that could cause harm or offence to others
• Respect the property and equipment provided for activities
• Report any safety concerns or incidents immediately to staff

Elevate Together reserves the right to remove any participant who violates this code of conduct or behaves in a manner that endangers themselves or others.

7. Children and Young People

For participants under 18 years of age:

• A parent or legal guardian must sign this waiver on behalf of the minor
• The parent or guardian agrees to the terms on behalf of the child
• Children must be supervised by a responsible adult unless otherwise specified
• Emergency contact information must be provided for all minors

8. Emergency Procedures

In the event of an emergency, I authorise Elevate Together staff and volunteers to:

• Administer first aid or emergency treatment as necessary
• Contact emergency services on my behalf
• Transport me to a medical facility if required
• Contact my emergency contact person

I agree to bear all costs associated with emergency medical treatment or transportation.

9. Indemnification

I agree to indemnify and hold harmless Elevate Together, its directors, officers, employees, volunteers, and agents from any and all claims, liabilities, damages, costs, and expenses (including legal fees) arising from my participation in activities or from any breach of this Waiver.

10. Data Protection

Any personal information collected as part of event registration will be processed in accordance with our Privacy Policy. We will only use your information for the purposes of administering activities and ensuring your safety.

11. Governing Law

This Waiver is governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this Waiver shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
